The B.C. government has appointed an acting chair to start work on B.C.'s new Civil Resolution Tribunal, Canada's first-ever online tribunal that will help citizens resolve strata and small claim disputes.

Over the next six months, the new chair, Cheryl Vickers, will do the foundational work required to get the Civil Resolution Tribunal up-and-running. She will lead ongoing consultations and the development of the tribunal's processes, rules and technology. Vickers' background includes extensive experience with B.C. tribunals, including the development of the British Columbia Council of Administrative Tribunals.

The creation of a tribunal is one of the commitments government made in a white paper on justice reform and is among a number of actions aimed at increasing timeliness and efficiency in the justice system, promoting early resolution and giving British Columbians alternatives to resolving their disputes in court.

The Civil Resolution Tribunal will offer a full array of online tools, available 24/7, to help British Columbians solve common strata and small civil claims. The independent tribunal will provide families, small business owners, the strata community, and others with a convenient, speedy and cost-effective alternative to going to court.

This project, which government has committed up to $500,000 towards as an initial investment, will be focused on meeting citizen needs, user satisfaction, and continuous improvement through innovation, and is part of the government's pledge to modernize the justice system.

Quick Facts:

  • The February 2012 green paper on justice reform identified tribunals as a simple and less expensive solution to easing delays in the court system.
  • In the second of two white papers on justice reform, the B.C. government committed to appoint a Civil Resolution Tribunal chair and invest in new technology to launch this service.
  • Government passed legislation in May 2012 to allow the establishment of the Civil Resolution Tribunal.
  • The Civil Resolution Tribunal is an alternative to court for people seeking to resolve small claims and most strata property disputes. The tribunal will encourage people to use a broad range of dispute resolution tools to resolve their disputes as early and efficiently as possible, while still preserving formal adjudication as a valued last resort.
  • Resolving a dispute through the tribunal is expected to take about 60 days, compared to 12 to 18 months for small claims court.
  • Public consultations for the Civil Resolution Tribunal's model demonstrated strong support among the strata property community, with 95 per cent of respondents to the online survey indicating they favoured this approach.
  • There are more than one million strata property owners and residents in the province. Approximately 29,000 strata corporations make decisions under the Strata Property Act.

BACKGROUNDER

Biography of Cheryl Vickers

Cheryl Vickers has served as chair of the Property Assessment Appeal Board since 2003. She has also served as chair of the Surface Rights Board, formerly called the Mediation and Arbitration Board, since 2007.

Vickers was active in the development of the British Columbia Council of Administrative Tribunals (BCCAT) and has worked in a number of positions on the BCCAT's board of directors, including as secretary from 1996 to 1998 and president from 2004 to 2006. In 2009, she received BCCAT's recognition award for outstanding contribution to administrative justice.

Vickers has instructed and assisted in curriculum development for BCCAT courses, offering training to appointees of quasi-judicial boards and tribunals. Vickers also serves on the editorial boards of the Continuing Legal Education Society of British Columbia's Real Property Assessment and Administrative Law Practice Manuals.

Vickers obtained a law degree from the University of Victoria and was called to the B.C. bar in 1985. She has practised in a variety of fields, including administrative law.

La nomination d'une nouvelle présidente donne le coup d'envoi à la création du tribunal virtuel

Le gouvernement de la Colombie-Britannique nomme une présidente par intérim qui amorcera les travaux qui mèneront à la création du premier tribunal virtuel au Canada. Ce tribunal aidera les citoyens dans le règlement de différends sur les copropriétés ou de litiges à petites créances.

Au cours des six prochains mois, la nouvelle présidente, Cheryl Vickers, réalisera les travaux de base qui permettront la mise en place du Civil Resolution Tribunal (tribunal civil de résolution des différends). Madame Vickers organisera des consultations permanentes et dirigera l'élaboration des mécanismes, de la technologie et des règles qui régiront ce tribunal. La nouvelle présidente possède une vaste expérience avec les tribunaux de la Colombie-Britannique. Elle a travaillé notamment à la mise sur pied du British Columbia Council of Administrative Tribunals (conseil des tribunaux administratifs de la Colombie-Britannique).

La création d'un tribunal virtuel est l'une des mesures auxquelles s'était engagé le gouvernement dans un livre blanc sur la réforme de la justice. Ce projet fait aussi partie des mesures visant à accroître l'efficacité et à réduire les délais dans le système de justice, à favoriser une résolution plus rapide des différends et à offrir aux Britanno-Colombiens des solutions de rechange à la résolution de leurs différends devant les tribunaux.

Le Civil Resolution Tribunal offrira un large éventail d'outils en ligne, accessibles 24 heures sur 24, 7 jours sur 7, afin d'aider les Britanno-Colombiens à régler les poursuites civiles et les différends en matière de copropriété. Ce tribunal indépendant offrira aux familles, aux propriétaires de petites entreprises, au secteur de la copropriété et aux autres citoyens une solution de remplacement aux tribunaux pratique, rapide et rentable.

Ce projet, dans lequel le gouvernement s'est engagé à investir jusqu'à 500 000 $ au départ, se concentrera sur les besoins des citoyens, la satisfaction des utilisateurs du tribunal virtuel et son amélioration continue par l'innovation. Il fait partie des engagements du gouvernement à moderniser notre système de justice.

Quelques faits :

  • Le livre vert de février 2012 sur la réforme de la justice désignait les tribunaux comme une solution simple et moins coûteuse pour réduire les délais dans l'appareil judiciaire.
  • Dans le second des deux livres blancs sur la réforme de la justice, le gouvernement de la Colombie-Britannique s'était engagé à nommer un président et à investir dans les nouvelles technologies pour le lancement de ce service.
  • En mai 2012, le gouvernement a adopté une loi pour permettre la création du Civil Resolution Tribunal.
  • Le Civil Resolution Tribunal est une solution de rechange aux tribunaux traditionnels pour résoudre des litiges à petites créances ou touchant la copropriété. Le tribunal encouragera les citoyens à utiliser un large éventail d'outils de résolution des différends pour trouver des solutions aussi rapidement que possible, tout en conservant l'arbitrage officiel comme dernier recours.
  • Résoudre un différend par l'intermédiaire du nouveau tribunal devrait exiger environ 60 jours, comparativement à de 12 à 18 mois au tribunal des petites créances.
  • Les consultations publiques sur le modèle du Civil Resolution Tribunal font état d'un appui considérable dans le milieu de la copropriété - 95 % des répondants à un sondage en ligne se disent favorables à cette approche.
  • Plus de un million de personnes vivent en copropriété ou sont propriétaires d'un appartement en copropriété dans la province. Environ 29 000 syndicats de copropriété fondent leurs décisions sur la Strata Property Act (loi sur les copropriétés).

Biographie de Cheryl Vickers

Depuis 2003, Cheryl Vickers était présidente du Property Assessment Appeal Board (comité d'appel de l'évaluation foncière). Depuis 2007, elle présidait aussi le Surface Rights Board (conseil des droits de surface), auparavant connu sous le nom de Mediation and Arbitration Board (conseil de médiation et d'arbitrage).

Madame Vickers a travaillé activement à la mise sur pied du British Columbia Council of Administrative Tribunals (BCCAT) et a occupé de nombreuses fonctions au sein du conseil d'administration de cet organisme, notamment comme secrétaire, de 1996 à 1998, puis comme présidente, de 2004 à 2006. En 2009, elle a reçu le prix hommage du BCCAT pour sa contribution exceptionnelle au droit administratif.

Cheryl Vickers a commandé et contribué à la préparation des programmes de cours du BCCAT et assuré la formation des personnes nommées aux tribunaux et aux instances quasi judiciaires. Elle a aussi siégé au conseil éditorial des guides d'évaluation foncière et de pratique du droit administratif Real Property Assessment and Administrative Law Practice Manuals de la Continuing Legal Education Society of British Columbia (société de formation continue en droit de la Colombie-Britannique).

Madame Vickers est diplômée en droit de l'Université de Victoria et est entrée au Barreau de la province en 1985. Elle a pratiqué dans de nombreux domaines, notamment en droit administratif.
