Amendments to the Freedom of Information and Protection of Privacy Act were introduced in the legislature today by Labour, Citizens' Services and Open Government Minister Margaret MacDiarmid.

"These amendments serve to modernize an act that came into force in 1992, when the majority of citizens had not even heard of the Internet," said Minister MacDiarmid. "We are aligning the act with current-day technology and with the way British Columbians want to be served by government today."

The amendments to the act are the result of recommendations by the Special Committee to Review the Freedom of Information and Protection of Privacy Act, the Office of the Information and Privacy Commissioner, and from 118 submissions from stakeholders including the Union of British Columbia Municipalities and the broader public sector.

They also reflect the results of consultation with British Columbians on service delivery, where findings revealed the vast majority of citizens access services online and expect the same service experience with government.

The proposed legislation would bring in new provisions to support a more effective and efficient application of the Freedom of Information and Protection of Privacy Act (FOIPP Act). Specifically, the amendments:

* Support open government by enshrining into law the policy direction recently taken with open data and open information.

* Allow citizens to consent to have their information collected where it results in improved service delivery.

* Enable the development of a provincial identity management system, which paves the way for citizens to have secure online government identification.

* Enable information sharing across government in specific circumstances where programs touch multiple ministries while adding new authorities for the Information and Privacy Commissioner to ensure that we protect personal privacy.

* Create rules, in consultation with the Information and Privacy Commissioner, on topics like data linking.

The Freedom of Information and Protection of Privacy Act gives people the legal right of access to records in the custody of public bodies, while at the same protecting citizens' private information.

BACKGROUNDER

Amendments set foundation for online services

The proposed amendments to the Freedom of Information and Protection of Privacy Act (FOIPP Act) will allow for the development of a provincial identity management system which gives citizens the choice to verify their identity securely online. Together with other amendments in the package, Bill 3 provides a comprehensive foundation for electronic service delivery and the necessary oversight to ensure it is done in a way that is respectful of personal privacy.

Possible scenarios for online services:

1. Online access to health care information

* Clients could be able to securely access a service that could include information such as their own medical records -their prescriptions and prescription history, or lab test results. Only the client, or authorized medical professionals, would have access to the client's information.

2. Confirming age, status as a student, or residency, while protecting privacy

* The new services card has been designed from the outset with a paramount focus on privacy protections and security. The design makes it possible to reveal only the essential information required in order to gain access to a service or perform an activity.

* The services card (in some cases used in conjunction with other services), could make it possible to reveal specific pieces of information. For example, a client could obtain a statement they are "19 or over" or confirm their status as a "Resident of B.C." all without disclosing additional, possibly unrelated, personal information. This is in contrast to today's common practice of requesting "government issued ID" which can have the unintended side effect of providing the requestor with all of the information printed or displayed on the card.

3. Securely change an address with government programs

* Tasks such as updating an address could be made simpler via secure online access.

Des amendements proposés en vue de renforcer la Loi sur la protection de la vie privée

Un projet d'amendements à la Freedom of Information and Protection of Privacy Act - la Loi sur le droit à l'information et la protection de la vie privée - a été déposé à l'Assemblée législative par la ministre du Travail, des Services aux citoyens et du Gouvernement transparent, Margaret MacDiarmid.

" Ces amendements permettront de moderniser une loi entrée en vigueur en 1992, alors que la majorité des citoyens n'avaient jamais entendu parler d'Internet ", a expliqué la ministre MacDiarmid. " Nous voulons adapter la loi aux technologies de notre époque et à la façon dont les Britanno-Colombiens souhaitent être servis, de nos jours, par le gouvernement. "

Ces amendements font suite aux recommandations du Comité spécial de révision de la Freedom of Information and Protection of Privacy Act, de l'Office of the Information and Privacy Commissioner (Bureau du commissaire à l'information et à la protection de la vie privée) et aux quelque 118 mémoires présentés par divers intervenants dont l'Union of British Columbia Municipalities et le secteur public à une échelle plus large.

Les amendements proposés s'inspirent également des résultats d'une consultation effectuée auprès des Britanno-Colombiens sur la prestation de services. Cette consultation a révélé que la vaste majorité des citoyens ont maintenant accès à des services en ligne et s'attendent à la même qualité de services de la part de leur gouvernement.

La loi proposée comporterait de nouvelles dispositions dont l'objectif est de favoriser une application plus efficace de la Freedom of Information and Protection of Privacy Act (Loi FOIPP). Ces amendements visent plus précisément :

* à appuyer le gouvernement transparent en incluant à la loi l'orientation politique récemment adoptée concernant la transparence des données et de l'information;

* à permettre aux citoyens de consentir à ce que de l'information les concernant soit recueillie en vue de leur garantir une meilleure prestation de services;

* à permettre la création d'un système provincial de gestion de l'identité, qui ouvrira la voie à une identification plus sécuritaire des citoyens dans le contexte du gouvernement en ligne;

* à permettre le partage de l'information dans l'ensemble du gouvernement lorsque les programmes touchent plusieurs ministères, en donnant de nouveaux pouvoirs au commissaire à l'information et à la protection de la vie privée pour assurer une protection accrue des renseignements personnels des citoyens;

* à créer, en consultation avec le commissaire à l'information et à la protection de la vie privée, des règles appelées à régir entre autres les questions qui touchent le couplage des données.

La Freedom of Information and Protection of Privacy Act donne aux citoyens un droit d'accès aux dossiers que détiennent les organismes publics, tout en protégeant du même coup les renseignements personnels des citoyens.

Ajouté aux autres amendements prévus, le projet de loi 3 constitue un fondement très complet sur lequel pourra se baser la prestation électronique des services et qui permettra d'assurer la surveillance nécessaire afin que ces services puissent être offerts dans le respect de la confidentialité des renseignements personnels des citoyens.

Voici un aperçu des possibilités qu'offriront les services en ligne :

1. Accès aux renseignements sur la santé par Internet

* Les clients pourraient être en mesure d'accéder de manière sécuritaire à un service qui pourrait comprendre de l'information telle que leur propre dossier de santé - avec leurs ordonnances et l'historique de leurs ordonnances, ou les résultats de leurs examens, par exemple. Seuls le client et des professionnels de la santé autorisés auraient accès aux renseignements sur le client.

2. Confirmation de l'âge, du statut d'étudiant ou du lieu de résidence, avec protection de la confidentialité

* La nouvelle carte de services a été conçue à l'origine avec une préoccupation importante pour la protection et la sécurité des renseignements personnels. Sa conception fait en sorte que seuls les renseignements essentiels nécessaires pour accéder à un service ou réaliser une activité pourront être divulgués.

* La carte de services (utilisée dans certains cas conjointement avec d'autres services) pourrait faire en sorte qu'il soit possible de ne divulguer que des segments de renseignements précis. Ainsi, un client pourrait obtenir une attestation précisant qu'il est âgé de " 19 ans ou plus " ou qui confirmerait qu'il est bien " résident de la Colombie-Britannique " sans que d'autres renseignements non pertinents le concernant aient à être divulgués. Le tout est bien différent du mode de fonctionnement actuel, où le fait de demander " une pièce d'identité émise par le gouvernement " équivaut à remettre à la personne qui la demande toute l'information qui apparaît sur la pièce en question, sans que cela soit réellement nécessaire.

3. Changement d'adresse en toute sécurité dans les programmes gouvernementaux

* Des tâches telles que la mise à jour de l'adresse de résidence pourraient se faire beaucoup plus facilement grâce à un accès Internet sécurisé.
